Post Pass Violations and Penalties

Administrative – this includes passes that are expired, lost, or cancelled. It also includes port passes that are not working due to a problem with the pass, sticky fronts that are peeling off, or passes that the fronts are worn off or the picture no longer looks like the individual.

• Port Pass will be confiscated and returned to the BCMEA.

Counterfeiting or lending or using someone else’s Port Pass – this includes any alteration to the port pass including pasting a picture over a different port pass. The use of someone else’s pass may or may not be accidental, the intent is to have Transport Canada investigate and make this determination.

• Confiscation and Transport Canada, Port Authority, and Police intervention.

Site Violation – this involves any life safety issues that occur on a terminal. It includes cancelling access privileges only for the terminal that the infraction occurred at. It also includes procedural violations that relate to that specific terminal. The port pass is not cancelled for the full system and the person is permitted to work at other locations. The Port considers itself a site and treats violations or breaches individually.

1st Offense – Access Suspension pending site investigation.
2nd Offense – Confiscation and revoked for 90 days.
3rd Offense – Confiscation and indefinite revocation.
4th Offense – Confiscation and revocation of Port Pass.

Cooperation with Port/Terminal Security – this includes compliance with security requests or directions in a timely fashion.

1st Offense – Warning – note to IRMS, CAMS and TLS.
2nd Offense – Confiscation and revoked for 7 days.
3rd Offense – Confiscation and revoked for 90 days.
4th Offense – Confiscation and revocation of Port Pass.

Violence – Verbal threats/harassment or other – this includes making threatening gestures.

Harassment is based on individual interpretation. Intimidation is included in this category.

1st Offense – Immediate 7 day revocation, confiscation, and report to police.
2nd Offense – Confiscation and revocation of Port Pass and a report to police.

Violence Physical – this includes the attempt to cause physical injury such as a swing and a miss, as well as actual physical contact. It would also be someone using a truck or vehicle in a threatening way.

• Confiscation and revocation. Transport Canada, Port Authority, and Police intervention.

Unsafe Acts on Port Property – This is a new request that may assist with some of the ongoing issues taking place on the roadways related to stopping or speeding on the roadways.

2nd Offense – Confiscation and revoked for 90 days.
3rd Offense – Confiscation and indefinite revocation.
4th Offense – Confiscation and revocation of Port Pass.

Confiscation means the card is taken away and returned to the issuing agency or the Port Authority or Transport Canada as the offense dictates.

Revocation means the person will not be able to reapply for a Port Pass while this is taking place. This may be for a specified time or total revocation and not eligible for reapplication.

The list is not all inclusive. Tailgating or piggybacking for access is a breach of security. It is not specifically listed as this has significant ramifications. It ranges from having the Police remove an individual from wherever the person is, even if they are on a work site. Transport Canada may have something to say as well.
